Magdalo Rep. Gary Alejano filed the first impeachment complaint against President Rodrigo Duterte on March 16. He cited betrayal of public trust, culpable violation of the Constitution, engaging in bribery, graft and corruption, and other high crimes as his complaint’s grounds for impeachment. He filed a supplemental complaint on March 30 for failure to defend the Philippines’ sovereign rights and territorial claims involving the Chinese’ activities in Benham Rise, Scarborough Shoal, and other disputed areas in the South China Sea.

However, Okd2.com claimed that the House panel junked Alejano’s impeachment complaint.
Okd2.com is not exactly a credible source, considering how many articles we have busted from the website.
On April 3, it wrote that the House Committee on Justice led by Mindoro Rep. Atty. Reynaldo Umali has rejected the impeachment complaint filed against Duterte. It did not pass the first reading, with lawmakers unanimously voting “lack of substantial evidence.”
But how can the House of Representatives do anything about Alejano’s complaint when the session is adjourned?
According to the 17th Congress’ calendar, the session has been adjourned from March 18 to May 1. It will resume on May 2 and session will continue until June 2.

According to the rules of procedure in impeachment proceedings, if the Committee on Justice finds the complaint insufficient, this is what it was deemed to do.
“If the committee finds that the complaint is insufficient in form, it shall return the same to the Secretary General within three (3) session days with a written explanation of the insufficiency. The Secretary General shall return the same to the complainant(s) together with the committee’s written explanation within three (3) session days from receipt of the committee resolution finding the complaint insufficient in farm.”
So, Okd2.com is up to its old tricks of making up stories. Until the Congressional session resumes, the House Committee on Justice cannot decide whether to junk the impeachment complaint against Duterte or not.
